Ajman Emiri Decree No 4_2017 Regarding Human Resources
The given law, Ajman Emiri Decree No. 4/2017 Regarding Human Resources, covers various aspects related to human resources in the Emirate of Ajman. It includes provisions on the issuance and renewal of residence permits and identity cards for non-national employees, with the government entity bearing the associated costs. However, the government entity is not responsible for the costs of residence permits and identity cards for family members. Chapter 4 focuses on transfer, delegation, and secondment of employees. It states that the competent authority may transfer an employee to another equivalent position within the same government entity or to another government entity with the consent of both entities' competent authorities. The transfer may be made to a vacant position at the receiving government entity, and the employee's financial allocations will be transferred accordingly. The law also allows for the transfer of national employees to entities affiliated with the Federal Government or other Emirates' governments, subject to the employee's agreement. Chapter 5 addresses functional degrees and appropriations. It states that the Central Administration will prepare a scale of degrees and salaries, which will determine the basic salary, supplementary allowance, and gross salary for each functional degree. The law allows for adjustments to the scale when necessary. The Implementing Regulation will determine the types and conditions of granting commissions, allowances, and other functional appropriations. Chapter 6 focuses on performance management. It establishes a Performance Management System to evaluate employees' performance annually, measure their competence, and improve their skills and achievements. The system includes evaluation procedures, adoption of evaluation reports, and the employee's involvement in the process. The results of the annual performance evaluation serve as the basis for calculating entitlements such as periodic allowances, promotions, increment, and performance incentives. Chapter 7 covers promotions, bonuses, and incentives. The government entity may grant functional, financial, and exceptional promotions to stimulate employee performance and increase productivity. Promotions are subject to specific conditions, including meeting job requirements, having a satisfactory performance evaluation, and meeting training or qualification criteria. The law also allows for the granting of encouragement bonuses and performance incentives to exceptional employees, with the Central Administration preparing a system to determine the categories and values of such rewards. Chapter 8 addresses different types of leaves, including annual leave, sick leave, maternity leave, paternity leave, bereavement leave, iddat leave, hajj leave, patient escort leave, study leave, exceptional leave, and unpaid leave. The law specifies the duration and conditions for each type of leave, such as the number of working days granted and whether the leave is paid or unpaid. Overall, the law aims to regulate various aspects of human resources in Ajman, including employment, transfers, promotions, performance management, and leaves, while ensuring fairness, objectivity, and the protection of employees' rights.
