Ajman Emiri Decree No 14_2006 On The Reorganisation Of Ajman Municipality And Planning Department
Ajman Emiri Decree No. 14/2006 reorganizes the Ajman Municipality and Planning Department, renaming it and establishing a new organizational structure. The decree designates various divisions within the Department, including public health and environment, agriculture and public gardens, roads and infrastructure, buildings, and service centers in Masfoot, Manama, and Al-Hamidieh. The Chairman of the Department has the authority to modify the competencies and powers of these divisions. The Department's responsibilities include infrastructure development, approval of urban and development projects, supervision of construction and demolition activities, regulation of public transportation, control of public parking lots, and establishment of trading regulations for food and consumer products. The decree also addresses the rights and obligations of the Department's employees. They are entitled to the protection prescribed by law for public employees, ensuring they are not subjected to abuse or opposition while performing their duties. The employees are held accountable for executing their occupational duties without abusing their powers. They are subject to the provisions of Decrees no. (9) and no. (10) of 2002, unless the Chairman of the Department requests the Ruler to exclude certain employees or categories of workers from these provisions for the interest of the Department's work. The decree further establishes the capacity and powers of the Municipal Inspector within the Department. The Municipal Inspector acts as a Law Enforcement Authority to detect violations of local orders issued by the Department or federal laws and Emiri decrees implemented in the Emirate. They have the authority to enter commercial stores and public or private places to investigate violations, gather evidence, and draft records of detected violations. These records, when signed by the offender and witnesses, hold authenticity unless proven otherwise. The Municipal Inspector must conduct inspections with integrity and responsibility, without abuse or physical harm to the offender or their properties. Additionally, Ajman Emiri Decree No. 6/2011 introduced a new article (10a) granting law enforcement authority to specific administrative positions within the Department, including the directors of the divisions of legal affairs, economic licenses, and public services, along with their respective section heads. The decree abrogates the Law of Ajman Municipality and Ajman Emiri Decree No. 7/2005, without affecting the validity of decisions or procedures taken under these laws. It is published in the Official Gazette of the Emirate of Ajman and communicated to relevant entities for implementation.
