Ajman Emiri Decision No 12_2014 On The Judicial Fees Of The Rental Disputes In Ajman

The given law is titled "Emiri Decision No. 12/2014 on the Judicial Fees of the Rental Disputes in Ajman" and it replaces the previous Ajman Emiri Decision No. 15/2007. It is issued by Ammar bin Humaid Al Nuaimi, Crown Prince of Ajman and Chairman of the Executive Council. The law applies to all rental lawsuits presented to the Rental Dispute Settlement Committee in Ajman. It does not apply to lawsuits and requests for which fees have already been paid or deferred before the law's effective date. The law establishes fees that will be charged on rental dispute lawsuits and other related claims. No lawsuit or claim will be registered unless the prescribed fee is collected. The competent department at the committee will reject any lawsuit or claim if the fees are not settled or partially deferred. The value of the lawsuit will be estimated based on the plaintiff's claims at the time of filing, and the highest fee will be collected if the plaintiff amends their claims during the process. Fractions of Dirham will be considered as one Dirham for fee calculation purposes. A separate fee will be charged for counterclaims in the original lawsuit, equivalent to the fees prescribed for the original lawsuit. If the lawsuit includes claims arising from different legal reasons, the fees will be estimated based on the value of each claim separately. If the lawsuit includes an original claim and accessory claim, the highest fee will be charged. Parties added to the plaintiff through joinder will be charged either the lawsuit fee or 4% of the value of their claims, whichever is higher. A part of the fees may be deferred, not exceeding half of the prescribed fees, upon the plaintiff's request and with the consent of the President of the Dispute Committee. The deferred fees will be charged before execution of the committee's judgment. Lawsuits, claims, and appeals filed by local or federal departments, authorities, or public institutions will be exempt from fees, unless a ruling compels the litigant to pay. The fees collected by virtue of this law will be considered as local government revenues and subject to the provisions of the unified financial system of the Government of Ajman. They will be registered within the accounts of the Municipality Department and accrued to the account of the Public Treasury of the Government of the Emirate. The fees ruled by the Dispute Committee will be considered as government debt and collected according to the procedures in force at the Government of the Emirate. The law abrogates the previous Administrative Decision No. 15/2007 on the fees of the Rental Dispute Settlement Committee in Ajman and any provision in local legislation that contradicts this law. The law was issued on Thursday, twenty-sixth of Ramadan 1435 H, corresponding to the twenty-fourth of July 2014, and was published in the Official Gazette of the Emirate of Ajman in 2014.
